EU to investigate national pay-TV film deals

(Telecompaper) The European Commission has started a competition investigation into national film rights granted by US studios to EU pay-TV broadcasters. The rights are normally agreed for broadcast only in one country, preventing the pay-TV providers from offering the films or TV series to customers in other EU states. The EC said that this "absolute territorial protection" may constitute an infringement of EU antitrust rules that prohibit anti-competitive agreements. The decision to investigate follows a landmark ruling in 2011 by the EU Court of Justice over the right of a subscriber to BSkyB services in the UK to show Premier League football matches at her pub in Greece. The court found that there was no justification for the Premier League to limit broadcast rights to national boundaries, when the cost of the rights could just as easily be based on the full or potential audience of a satellite or online TV provider across EU states. The EU investigation will focus on major US film studios, including Twentieth Century Fox, Warner Bros, Sony Pictures, NBCUniversal and Paramount Pictures, and the largest European pay-TV broadcasters, such as BSkyB of the UK, Canal Plus of France, Sky Italia of Italy, Sky Deutschland of Germany and DTS of Spain.

EchoStar, GVT end talks for pay-TV joint venture in Brazil

(Telecompaper) EchoStar Technologies and Vivendi's Brazilian unit GVT have announced they are no longer in discussions to form a joint venture for pay-TV services in Brazil. EchoStar said it remains committed to use satellite and video technology to deliver pay-TV services to Brazil via BSS satellite. Vivendi said it will also continue to develop GVT's pay-TV business.

Netflix talks distribution with US pay-TV providers - report

(Telecompaper) Netflix is in talks with several US pay-TV providers including Comcast and Suddenlink to make its online video service available as an app on their set-top boxes, people familiar with the matter told the Wall Street Journal. A deal would mark the company's first such tie-up with a US provider and follows a similar agreement recently announced with UK cable operator Virgin Media. The talks are in early stages and no deal is imminent, the report said. A hangup in the talks with at least two operators is that Netflix is insisting that they also take on its special technology designed to improve the delivery of its streaming video, the paper's sources said. The technology is part of its Open Connect program and consists of special servers Netflix wants to connect directly into broadband providers' networks. Comcast, Time Warner Cable, AT&T and Verizon have declined to use the technology, concerned that such an arrangement could lead other online services to ask for special treatment. The internet providers argue their broadband networks are fully capable of handling Netflix traffic, the report said.

Unotel Telecom, Media Networks and NAGRA have announced the signature of an agreement for the launch of a new pay-TV offering. The new service will be initially offered to the four million broadband subscriber base of the shareholders and partners of Unotel.
