BnA could force E-Plus, O2 to give up some frequencies

(Telecompaper) [Update] Germany's Federal Network Agency (BnA) is considering whether O2 and E-Plus will have to give up some of their frequencies if they proceed with their merger, reports German newspaper 'Frankfurter Allgemeine Zeitung' (FAZ). The regulator believes that their GSM licences as well as their UMTS licences are tied to their competitive independence. According to letters sent to E-Plus CEO Thorsten Dirks and Telefonica Germany CEO Rene Schuster, and seen by the FAZ, the regulator warns it could revoke their frequency allocation in an extreme case. BNA will examine the merger proposal and and has asked the companies to provide information within two weeks, according to the letter dated 25 July of this year. The agency will have to review whether the frequencies will still be "efficiently used" and whether the combination would hamper competition plus seeking comments from competitors, according to Bloomberg also citing from the letters. Both Telefonica and E-Plus commented to Bloomberg that the letters are part of their goal to receive quick regulatory approval.
BnA looks to raise billions from new spectum auction

(Telecompaper) Germany's Federal Network Agency (BnA) is looking to raise billions of Euros from a new auction of mobile spectrum, reports the 'Frankfurter Allgemeine Zeitung' newspaper. This will include spectrum already used by network operators Deutsche Telekom, Vodafone, E-Plus and Telefonica for voice and data communications, as well as 700 MHz 'Digital Dividend IUI' frequencies previously used for radio and TV. The network operators' licences for the spectrum they already use are due to expire in 2016. The plans are opposed by broadcasters and state media authorities, which insist that the 700 MHz spectrum is vital for guaranteeing delivery of DVB-T services. Meanwhile, the mobile network operators want the regulator to simply extend their GSM frequency licences without an expensive auction, as they are faced with falling revenues and network expansion costs.

BnA approves Deutsche Telekom vectoring proposals

(Telecompaper) Germany's Federal Network Agency (BnA) has issued a draft decision allowing Deutsche Telekom to upgrade its copper network using vectoring (VDSL2) technology for faster internet services. The regulator said that Telekom must provides rivals with access to the new technology, but could refuse access in areas where alternative networks are available. The decision was immediately attacked by German broadband network operators association Breko, arguing that it will make it much more difficult for Telekom rivals to build broadband networks.
