Although no one reading this article would disagree with the premise that employers cannot and should not tolerate bigotry from anyone in their workforce, the NLRB apparently thinks otherwise. In a troubling decision handed down earlier this month, National Labor Relations Board Administrative Law Judge Thomas M. Randazzo ruled that Cooper Tire & Rubber Company violated the National Labor Relations Act when it terminated an employee who hurled racist epithets at African-American replacement workers while the employee was on a picket line.

NLRB In ConAgra Ruling Signals What May Be Solicitation

The National Labor Relations Board recently decided that discipline of an employee for violation of the employer's nonsolicitation policy was unlawful, even though the employee engaged in union-related discussion and the discussion prompted another employee to stop working on the production floor during work time. While the NLRB's decision appears to construe the term solicitation so narrowly that an employer's nonsolicitation policy is rendered ineffective, an employer can still enforce its nonsolicitation policy if it applies the policy in accordance with the NLRB's definition of solicitation and in a nondiscriminatory way.

NLRB rejects 'bad faith' claims against FairPoint

FairPoint Communications says the National Labor Relations Board has dismissed complaints accusing the company of bargaining in bad faith, disappointing news for striking workers in Maine, New Hampshire and Vermont. The Communications Workers of America and the International Brotherhood of Electrical Workers said they were appealing.

The National Labor Relations Board decided 3-2 last week that employees covered by the National Labor Relations Act are presumptively entitled to access an employer's email systems for communicating under Section 7 of the NLRA during their non-working time if the employer gives the employees access to the email system for business communication. The Board majority in Purple Communications consisted of the three Democrats, Chairman Mark Gaston Pearce, and Members Nancy Schiffer and Kent Hirozawa.
