A federal appeals court has upheld the dismissal of Kmart Corp.'s lawsuit against a shopping center owner for flood damage to one of its stores in Corinth, Miss. Kmart contended it had evidence to support its arguments that property owner Fulton Improvements LLC knew that a neighboring Kroger was built in a floodway and caused water to flood the Kmart store in 2010.

Toyota Motor Corp. is asking a federal court to reduce the amount of money it was ordered to pay plaintiffs who successfully sued the automaker over a fatal crash in St. Paul. A jury determined Toyota was 60 percent to blame for the 2006 crash and that the victims should be paid about $11 million.

Exemplifying the reluctance of many courts to allow toxic tort cases to proceed as class actions, a federal judge in Arkansas denied certification of a putative class of neighboring landowners who claimed the Defendant's failure to adequately remediate contamination damaged their property values. See Whirlpool Corporation discovered the presence of elevated concentrations of triochloroethylene in the soil and groundwater of its Fort Smith, Arkansas manufacturing plants in the 1980s, and subsequently agreed to investigate and remediate impacted groundwater at the northern portion of its facility.

Federal Court orders Apple to turn over documents to Competition Bureau

Apple Canada Inc. has been ordered to hand over "relevant" documents to the Competition Bureau related to an investigation into whether Apple uses anti-competitive clauses to push the sale of its iPhones. Wednesday's ruling by Chief Justice Paul Crampton of the Federal Court of Canada came about a week after the bureau filed an application to require the Canadian subsidiary of the U.S. computer giant and smarphone maker to provide written records.
