High Court sides with Google in AdWords dispute

(Telecompaper) Australia's High Court has cleared Google of allegations of misleading and deceptive conduct, The Australian reports. The Australian Competition and Consumer Commission (ACCC) took the search giant to court in 2007 over the way it displays its search results. The regulator alleged that Google and the Trading Post breached the Trade Practices Act in 2005 because Google's advertising program, AdWords, was used by some companies to create links to their websites via ads that wrongly referred to their rivals. Initially, Google won the case in Federal Court but the ACCC was successful on appeal. Google then applied to the High Court to resolve the matter. The High Court agreed with Google that it had not created the links and had not engaged in misleading or deceptive behaviour. In a statement, the ACCC said it will carefully review the judgment of the High Court to understand whether it has broader ramifications and will consider any consequences for enforcement of the Australian Consumer Law.
