KPN fined almost EUR 1 mln over wholesale obligations

(Telecompaper) Dutch regulator ACM has fined KPN almost EUR 1 million for failure to notify rivals on time of the introduction of new wholesale services on its fixed network. The ACM issued fines in four cases in 2010-11 where KPN did not meets its transparency and non-discrimination obligations. The regulator said the company must notify rivals at least two months before launching a new service. KPN has contested the time period and said it will file an appeal against the sanctions. The fines include EUR 20,604 for the late notification of wholesale MDF service for VDSL, EUR 222,685 for a temporary promotion of the wholesale FTTC service, EUR 292,300 and 365,375 at the introduction of the wholesale VDSL-CO DLM service and EUR 40,007 and EUR 32,005 from the introduction of the VDSL-Buitenring wholesale access services. In all the cases the fines were increased as they were considered repeat offenses.
