A lawsuit filed by a supermarket chain headquartered in Montvale seeking to invalidate the borough's 2013 amendment to its master plan as well as an ordinance supplementing Chapter 128 of the borough code to establish an Affordable Housing/Planned Unit Development district zone in the borough on DePiero's Country Farm was denied by a superior court judge last week.
