New FCC Order Expands Liability for Businesses Under the TCPA

On July 10, 2015, the Federal Communications Commission issued a declaratory ruling and order under the Telephone Consumer Protection Act, 47 U.S.C. A 227 , resolving 21 separate requests for clarification from consumers and industry groups in the face of growing litigation and technological changes in the field of telemarketing. The FCC's order expands the scope of TCPA liability by broadly interpreting key definitions and effectively eliminating some defenses that businesses have used to defeat TCPA litigation in the past.

Merging Cable Companies List Benefits for FCC Approval

Charter Communications, Inc., Time Warner Cable Inc. and Advance/Newhouse Partnership recently filed a public interest statement with the FCC seeking approval of the proposed merger of the companies. The FCC must determine whether the merger serves the public interest, convenience and necessity by weighing the potential public interest harms and benefits and whether the merger violates or interferes with the Communication Act's objectives.

AT&T said to win antitrust approval for DirecTV with FCC pending

AT&T's $48.5 billion deal to buy DirecTV is set to be cleared by U.S. antitrust officials without any conditions, said a person familiar with deliberations by the Justice Department. The merger still needs approval from the Federal Communications Commission, which could demand concessions such as following the agency's net neutrality rules.
