Apple, Ericsson Sue Each Other Over Royalties on Phone Patents

Apple Inc. and Ericsson AB are suing each other in U.S. courts after failing to reach an agreement over the pricing of wireless-technology patents used by the maker of the iPhone and iPad. Apple, saying that Ericsson is seeking excessive royalty rates, yesterday asked a federal court in California to rule that Ericsson's patents aren't essential to long term evolution, or LTE, standards.

Apple disputes terms of Ericsson licensing

(Telecompaper) Apple and Ericsson have filed lawsuits against each other after Apple declined to renew its license for Ericsson technology under the proposed terms. Ericsson said their licensign agreement expired recently, and despite two years of negotiations, they were unable to agree the terms of a new deal. Every Apple smartphone and tablet with cellular capability uses technology from Ericsson. Apple has filed a lawsuit asking the US District Court for the Northern District of California to find that it does not infringe a small subset of Ericsson's patents. In response Ericsson filed a complaint in the US District Court for the Eastern District of Texas requesting the court to determine if its global licensing offer for Ericsson's standard-essential patents to Apple is fair, reasonable and non-discriminatory (FRAND). Ericsson said it hoped to reach "a mutually beneficial resolution with Apple" and extend the companies' partnership.
