EC clears partial deregulation of Polish broadband market

(Telecompaper) The European Commission has approved the Polish regulator UKE's proposed regulation of wholesale broadband based on a regional breakdown of the market. The UKE determined that 76 areas in the country had sufficient competition due to the presence of alternative operators. As such, incumbent Orange Poland should not be subject to regulation of access to its network in these cities. The deregulation is expected to encourage investment in new fibre networks and competition in these areas. In the remaining areas of the country, Orange is designated a significant market power and will be subject to access, non-discrimination, regulatory accounting and price regulation and be expected to prepare a reference offer for alternative operators. The UKE first proposed 111 deregulated areas, but after objections from the EC, it revised the plan. The decision will be sent to the competition regulator Uokik for comment as well as market stakeholders before becoming final in early September.
