PCB Cleanup Suit Declared Time-Barred

A Connecticut federal judge recently dismissed a suit seeking to hold Monsanto and others responsible for the cleanup of polychlorinated biphenyls released from paint, finding that the plaintiff filed its suit after the two-year statute of limitations ran. U.S. District Judge Robert N. Chatigny of the District of Connecticut found that, because the plaintiff received sufficient notice of the contamination more than 15 years before filing its lawsuit, its claim is now time-barred.
