USTelecom starts legal challenge of FCC Open Internet rules

(Telecompaper) Industry association USTelecom filed a lawsuit against the FCC's Open Internet rules. Following publication of the net neutrality rules in the Federal Registry, opponents can appeal the regulations in court. USTelecom, which is challenging the rules in the US Court of Appeals for the District of Columbia, said the Open Internet regulation is "arbitrary and capricious, and violates federal law". While the industry supports net neutrality standards, it believes the FCC took the wrong approach in regulating the matter, by relying on Title II of the Telecommunications Act, USTelecom said in a statement. "Reclassifying broadband Internet access as a public utility reverses decades of established legal precedent at the FCC and upheld by the Supreme Court," USTelecom said. "History has shown that common carrier regulation slows innovation, chills investment, and leads to increased costs on consumers."

USTelecom Continues its Legal Fight Against FCC on Net Neutrality

The telecommunications trade group has filed a supplemental petition with the courts so it can keep its legal standing in the fight against recent net neutrality rules changes made by the FCC. In March, USTelecom, a Washington-based telecommunications trade group that is battling the FCC over recent net neutrality changes made by the agency, filed a protective petition for review with the U.S. Court of Appeals for the District of Columbia as a first step in its legal fight over the issue.

DUTIES The Legal Administrator will be assigned to the Programme Legal Services Division. Under the direct authority of the Head of Division, the Legal Administrator will receive work assignments involving the following tasks drafting opinions, reports and working documents on any legal problem arising in the Agencys daytoday operations and in the implementation of applicable rules and policies analysing legal documentation and conducting studies on the relevant legal and regulatory environment in which the Agency carries out its activities undertaking legal analysis, and preparing notes and briefs on public and international law and the national laws of Member States providing support in the preparation of the Agencys legal instruments providing legal advice on the formulation and interpretation of the Agencys Rules advising on laws and practices of public investment in large projects and infrastructures preparing draft agreements and other arrangements with public and private entities and participating in their negotiation, together with the Directorates concerned representing the Legal Department and attending committees and boards relevant to the above functions. QUALIFICATIONS Applicants for this post should have a Masters degree in law, including advanced studies in public international law or comparative law together with professional experience of at least five years in public administrations, international organisations or major law firms. The successful candidate should have professional experience of the laws and regulations applicable to public and private investment, as well as knowledge of the legal environment of space activities. The successful applicant should demonstrate the ability to work collaboratively in a team of lawyers, achieve professional goals, identify priorities and adjust them as required. The working languages of the Agency are English and French. A good knowledge of one of these two languages is required together with a working knowledge of the other language. Knowledge of another member state language is an asset. CLOSING DATE The closing date for applications is 7 May 2015.
