Hutchison wins appeal against EU decision blocking O2-3 UK merger

(Telecompaper) The EU's Court of Justice has overturned the European Commission's decision to block the merger of O2 UK and 3 UK in 2016. Following an appeal from 3 UK's parent company CK Hutchison, the court found the Commission did not prove sufficiently that the merger would have a negative effect on competition.

EC blocks O2-3 UK merger

(Telecompaper) The European Commission has blocked the proposed merger of O2 UK and 3 UK, saying competition on the UK mobile market would suffer with only three network operators. The decision is in line with calls from UK regulator Ofcom to maintain four players and follows lengthy negotiations with 3's owner CK Hutchison over possible concessions to maintain competition. Hutchison agreed the takeover of O2 from Telefonica in March 2015 for GBP 10.25 billion. The deal would have led to 3 UK jumping from fourth to first place on the UK market.

EC rejects UK review of proposed O2-3 UK merger

(Telecompaper) The European Commission (EC) has decided not to refer the planned acquisition of Telefonica UK (O2) by Hutchison to the UK competition authority. The EC decided that it was better placed to ensure consistency in the application of merger control rules in the European mobile telecoms sector. Hutchison 3G UK notified the EC of its plans to acquire control of Telefonica UK in September. In October, the UK competition authority submitted a request for the EC to refer all or part of the assessment of a case to it. The EC opened an in-depth investigation into the proposed deal on 30 October and has until 18 April 2016 to make a final decision.

(Telecompaper) The European Commission has opened an in-depth investigation into Hutchison's acquisition of O2 UK. The Commission said it's concerned that the merger of O2 and 3 UK could lead to higher prices, less choice and reduced innovation for mobile customers in the UK. The merger of O2 and 3 would create the UK's largest mobile operator and reduce the market from four network operators to three.
