A recent case out of the Eastern District of Missouri provides a perfect example of what judges should do when evaluating non-compete agreements: That is to say that judges should conduct a thoughtful analysis that accounts for the realities of the marketplace. Far too often, I find that enforcement of non-compete agreements involves dogmatic references to the sanctity of contract, a superficial analysis of the facts that overwhelmingly credit's the plaintiff's depiction of the market and boilerplate findings about confidential information and customer relationships.

The Supreme Court has sided with Teva Pharmaceutical Industries Ltd. in the company's high-profile patent dispute with rival firms over the top-selling multiple sclerosis drug. The justices ruled Tuesday that a federal appeals court wrongly overturned five of Teva's patents for the drug Copaxone.
