Merck remains committed to its $8.4 billion acquisition of Cubist Pharmaceuticals even though a federal court invalidated most of the patents protecting the company's top-selling antibiotic just hours after that deal was announced Monday. Shares of both companies tumbled Tuesday morning in the first day of trading after Cubist said a federal court invalidated four patents protecting Cubicin.

Cisco files patent, copyright suits against Arista

(Telecompaper) Cisco Systems has filed two lawsuits against Arista Networks alleging patent and copyright infringement. According to Cisco's general counsel Mark Chandler, the suit covers 12 Cisco features covered by 14 different US patents and currently in use in Cisco products. None are incorporated in industry standards. They were patented by individuals who worked for Cisco and are now at Arista, or who at Cisco worked with executives who are now at Arista, Chandler said. The company also accused Arista of copying Cisco user manuals, including grammatical errors. In addition, Arista lifted over 500 multi-word command line expressions from a Cisco interface for its own. Chandler said Arista has its own interface, but it chooses to use Cisco's because customers are more familiar with it. Jayshree Ullal, a former Cisco senior vice president who is Arista's chief executive, told the Wall Street Journal that the company had not yet received Cisco's formal complaints. But she added: "I am disappointed at Cisco's tactics. It's not the Cisco I knew."
