US govt upholds ITC ban on Samsung smartphone imports

(Telecompaper) Samsung has lost a bid to prevent a ban on the import to the US of some of its smartphones. The Korean company had been hoping that US President Barack Obama would use his veto right to overturn the ban resulting from a decision by the International Trade Commission in a patent dispute with Apple. "After carefully weighing policy considerations, including the impact on consumers and competition, advice from agencies, and information from interested parties, I have decided to allow" the import ban to proceed, the US Trade Representative Michael Froman said in a statement reported by Bloomberg. Samsung can still seek a delay in the ban from a US appeals court that will consider the entire case on legal grounds. Samsung has argued the ban should be overturned on public policy grounds, especially since a similar order it won against Apple's iPhone 4S was thwarted by a presidential veto in August. The import ban is on a limited number of products. The ITC said newer models by Samsung had worked around the two Apple patents in the case, which covered a multitouch feature and one for a sensor for headphone jacks.

Canadian govt rejects Accelero acquisition of Allstream

(Telecompaper) The Canadian federal government has rejected the proposed acquisition by Accelero Capital of the Allstream division of Manitoba Telecom Services (MTS Allstream). The Canadian operator said it was "extremely surprised and disappointed" by the decision, adding that both companies responded "openly and constructively" to Industry Canada's requests for information in the 136 days since the transaction was announced. Accelero proposed far-reaching, comprehensive and binding undertakings to the Canadian government, including a commitment to invest USD 300 million over three years to pursue Allstream's capital plans. The government rejected the deal on national security concerns, and also rejected an offer from MTS and Accelero to take whatever actions were necessary to address government concerns. As a result of the fall-out, the Allstream division will once again be reported as part of MTS Allstream consolidated results. Results will be impacted by a one-off cost of CAD 35 million connected to the lost transaction. Excluding the impact of the additional transaction and restructuring costs, results were otherwise expected to be near the lower end of the original guidance ranges. The MTS subsidiary, which has not been impacted, continues to generate increased cash flow and is performing in line with expectations.
