Google appeals French data protection decision

(Telecompaper) Google has lodged an appeal against a EUR 100,000 fine handed down by French data protection commission Cnil, which found that the search engine company failed to take down certain search results in other countries. The internet giant argues that the regulator cannot order it to do anything elsewhere than in France. Cnil sees things differently. It claims that the 'right to be forgotten' has no borders precisely because the internet has no borders.

EU Parliament approves data protection legislation

(Telecompaper) The European Parliament has approved new data protection regulations in the EU, bringing to an end four years of negotiations on reforming the data protection directive dating from 1995. The legislation passed by parliament includes The General Data Protection Regulation, covering the processing of personal data, and a directive governing the handling and transfer of personal data by law enforcement authorities, including across EU borders. EU states will have two years to transpose the new rules into their national laws.

EC releases text of data protection deal with US

(Telecompaper) The European Commission has released the text of the proposed 'Privacy Shield' agreed with the US, which is expected to replace the previous safe harbour designation on data transfers from the EU to the US.  The publication includes a draft "adequacy decision" from the Commission as well as the Privacy Shield Principles companies have to abide by and written commitments by the US government on the enforcement of the arrangement, including assurance on the safeguards and limitations concerning access to data by public authorities. The EC found that the safeguards in the new agreement should uphold the standards under EU data protection law and meet the requirements of the EU Court of Justice's ruling in October 2015, which struck down the previous safe harbour designation for the US. However, the new agreement must still be approved by a committee of representatives of the 28 EU states, and the EU's national privacy regulators must also give their opinion on the Privacy Shield before it can take effect.
