The debate over standing in data breach litigation is gaining more attention lately. While many courts have hesitated to find standing prior to lost personally identifiable information actually being misused, the U.S. District Court for the Eastern District of Pennsylvania recently joined other courts who have found standing when the plaintiff has already suffered identifiable identity attacks, marking the first time a Pennsylvania federal court has allowed a data breach class action to proceed beyond the motion to dismiss stage.

In an October 1st decision , the Delaware Chancery Court dismissed claims that Zale Corporation's directors breached their fiduciary duties in connection with Zale's agreement to merge with Signet. The Court, however, permitted a claim to proceed against Merrill Lynch, Zale's financial advisor, for aiding and abetting a breach of fiduciary duty by Zale's board of directors.

In D'Arcy v Myriad Genetics Inc [2015] HCA 35 the High Court of Australia has unanimously held and two concurring decisions that claims to isolated nucleic acids coding for mutations or polymorphisms of the BRCA1 gene, do not meet the requirements of a 'manner of manufacture' within the meaning of the Patents Act 1990 and are therefore not a patentable invention in Australia. The High Court's decision overturned Justice Nicholas' decision at first instance, and a unanimous decision of an expanded bench of five judges of the Full Federal Court of Australia.

Appeals court hits largest public patent troll with $1.4M fee

The nation's top patent court has given its seal of approval to a hefty $1.4 million award of legal fees against the largest publicly traded "non-practicing entity," Acacia Research Corporation. The award was granted one year ago by US District Judge Gregory Sleet, and it was one of the first to be decided under the new Octane Fitness caselaw, which makes it easier for defendants to get their legal fees in baseless patent suits.
