One of Canada's media giants has launched an appeal of the broadcast regulator's ban on substituting Canadian advertising over American ads during the Superbowl. Bell Media has filed a motion with the Federal Court of Appeal seeking leave to appeal a Jan. 29 decision by the Canadian Radio-television and Telecommunications Commission that would prevent so-called simultaneous substitution of ads during the NFL final.

A federal appeals court in New York has revived a lawsuit accusing bedding retailer Select Comfort Corp of defamation for employing sales staff who discouraged undercover shoppers from buying beds at rival Sleepy's LLC. The 2nd U.S. Circuit Court of Appeals on Friday overturned a lower court's dismissal of Sleepy's lawsuit against Select Comfort, which also accused the maker of "Sleep Number" adjustable beds of breach of contract. Circuit Judge Pierre Leval wrote for a three-judge panel that the lower court did not properly assess whether Hicksville, New York-based Sleepy's had a good-faith business motive when it elicited the alleged disparaging statements.

South Carolina court orders Johnson & Johnson to pay $136 million in Risperdal case

South Carolina's Supreme Court ordered Johnson & Johnson to pay a penalty of $136 million, upholding a jury's finding that the drugmaker's Janssen unit had improperly marketed its anti-psychotic drug Risperdal and concealed its risks. A trial court had earlier ordered J&J to pay $327 million, but the Supreme Court more than halved that penalty, citing a provision in South Carolina law that no action can be taken in such cases after three years of the discovery of unlawful conduct.
