The Omaha company reported late last month that coal volume dropped 26 percent in its most recent quarter and said it believed that demand for coal would remain weak for the rest of the year. North Carolina's environmental officials moved Wednesday to stop an agreement that would commit Duke Energy to scooping out and moving coal ash from three more unlined and leaking pits. The state Department of Environment and Natural Resources argued in court that the deal between the country's largest electricity company and environmentalists skirted a state law dealing with the decades-old residue left after burning coal to produce power.

West Virginia environmental regulators say Patriot Coal's bankruptcy plan would leave the company with no assets to cover hundreds of millions of dollars in mine pollution cleanup. In a Monday filing in U.S. Bankruptcy Court in Virginia, attorneys for the Department of Environmental Protection wrote that Patriot's plan would expose people to public health and safety risks.
