Condemned Santa Clara County killer David Allen Raley has lost perhaps his last legal argument to get off California's death row for the 1985 murder of a Peninsula teenager and the attempted murder of her friend inside a deserted Hillsborough mansion. Santa Clara County Superior Court Judge Linda Clark this week rejected Raley's argument that he was mentally retarded at the time of the crime, a finding that would bar his execution under a 2002 U.S. Supreme Court ruling.

Reuters: Torrential rains that drenched much of the U.S. Southwest and killed two women earlier this week caused more than $1 million worth of damage to roadways in a Nevada county, officials said on Thursday. Nearly 140 homes in Clark County suffered damage following Monday's rains, and preliminary estimates from the county's public works department put the cost of cleaning and repairing area roadways at around $1.1 million, county spokeswoman Stacey Welling said in a statement. Bob Bowcock, chief environmental investigator for Erin Brockavich, is investigating a lawsuit between a Jones County family, Petro Harvester Oil and Gas Company, and others tied to Petro. Bowcock says a public nuisance declaration would help short circuit the process of getting the Department of Environmental Quality and the Mississippi Oil and Gas Board to extensively test for toxic chemicals.
