CA Supreme Court Issues First Decision Extending FTC v. Actavis to State Antitrust Litigation

The California Supreme Court issued a decision today in the Cipro antitrust cases, concluding that the analysis set forth by the U.S. Supreme Court in FTC v. Actavis applies to alleged "pay-for-delay" pharmaceutical patent settlements brought under the state's antitrust act, the Cartwright Act.

Elizabeth Warren recently announced that she wants the Consumer Financial Protection Bureau to apply the Dodd-Frank Act to automotive lenders, which are issuing higher numbers of subprime loans in recent years for higher credit risk consumers. Although Warren's intentions to reign in the subprime vehicle market before it affects our slowly recovering economy, the unintended consequences could be as bad - or worse - than the current lending climate.
