In a much-anticipated decision, the U.S. Supreme Court recently affirmed a $2.9 million judgment in a class action for unpaid overtime wages against Tyson Foods Inc. in which employee class members relied on representative and statistical evidence to establish class-wide liability. The Court held that the class-member employees could establish class-wide liability through the use of representative and statistical evidence because the class members could have relied on such evidence to establish liability in individual actions.

Tyson Foods Ruling Opens the Door for Use of Statistical Averaging in Wage and Hour Class Actions

Last week, in Tyson Foods, Inc. v. Bouaphakeo et al. , No. 14-1146, the United States Supreme Court ruled that class certification was appropriate in a wage and hour class and collective action, despite the lack of individualized evidence for the amount of uncompensated time worked by each class member.

China is even giving signs that its minimum wages could be raised in a more flexible manner in the coming years.
