UPDATE 2-Canada's Potash to spend over $53 mln in US Clean Air Act case

Potash Corp of Saskatchewan Inc agreed to spend more than $52 million on plant improvements and pay a $1.3 million civil penalty to resolve U.S. charges that it violated the Clean Air Act over the emission of harmful pollutants such as sulfur dioxide, U.S. authorities said. Thursday's accord with the world's largest fertilizer producer includes a consent decree, and is the largest in the U.S. Department of Justice's effort to address Clean Air Act violations by sulfuric acid producers.

CNMC fines Telefonica EUR 26 mln for 'restrictive' contracts

(Telecompaper) Spain's telecoms regulator CNMC has fined Telefonica a total of EUR 25.78 million for practices that limit the ability of its business customers to switch operators and change contracts. Telefonica is accused of including permanence clauses in its SME contracts that were automatically renewed and also included penalties that became increasingly higher as contract expiry date approached. The CNMC described the practice as anti-competitive in that it served to "disproportionately" limit the capacity of Telefonica's mobile customers to change operators. In addition, Telefonica's actions "substantially increased the costs that competitors had to incur to gain customers at the expense of Telefonica," said the CNMC in its decision. The regulator added that the fine reflected the fact that the permanence clauses had been in place since 2006, excluding other operators from the business segment of the mobile services market, which accounted for over 70 percent of Telefonica's revenues in the SME division in 2012. Telefonica has reacted "with perplexity" at the CNMC's decision, according to business daily Expansion, and will proceed to immediately lodge an appeal on grounds that the decision is clearly discriminatory against Telefonica, in that it ignores identical practices of other operators in the Spanish market.

Brazil: Rio 2016 says will offset 3.6 mln tonnes of emissions at Games

Reuters: The Rio 2016 local organizing committee set a target on Thursday to offset the total amount of greenhouse gases estimated to be produced by the world's largest multi-sport event. The Olympic Games are expected to generate 3.6 million tonnes of carbon dioxide equivalent (CO2e), mostly due to traveling and accommodation of spectators, the local organizing committee (LOC) said. That number is slightly larger than what was released by the London 2012 Games, at around 3.4 million tonnes of CO2e....

UPDATE 1-Kimberly-Clark faces $500 mln suit over Ebola protection gown

A Southern California law firm has sued Kimberly-Clark Corp for more than $500 million, alleging that the Kleenex tissue maker committed fraud by marketing and selling some of its surgical gowns as protection against Ebola. Law firm Eagan Avenatti said it filed a class-action lawsuit in a Los Angeles court on Wednesday, stating that Kimberly-Clark had falsely represented to health regulators and healthcare workers that its "MICROCOOL Breathable High Performance Surgical Gowns" are impermeable and provide protection against Ebola.

1 mln credit cards activated on Apple Pay in first 3 days

(Telecompaper) Apple CEO Timothy Cook said that 1 million credit cards activated on Apple Pay in the first three days that the mobile wallet went live, the New York Times reported. The CEO made the statement during a tech conference in Laguna Beach, California. Apple made deals with many merchants, including Whole Foods, Walgreens, McDonald's, Macy's and Nike. Some retailers are still holding out, with Rite Aid and CVS disabling Apple Pay from working with their stores. The shops are part of a group that is working on a competing mobile payment system. Cook suggested it was only a matter of time before the retailers came around. Cook also spoke about his desire to protect consumer privacy, following up on reports that the tougher security in Apple's new mobile software system, iOS 8 drew criticism from law enforcement officials, who said the new encryption methods would hinder investigations. Cook said that if a company were to design a way for the police to gain access to a user's data, it could end up in the wrong hands.
