Description Legal Officer in the Legal Services Department, Directorate of Industry, Procurement and Legal Services. The Legal Officer reports initially to the Head of Department and may later be reassigned to one of the divisions. Duties Under the direct authority of the Head of Department, the Legal Officer as a member of the team in the Legal Services Department, contributes to the legal counselling in the Agency and supports all related legal and administrative functions. The holder of the post will receive work assignments on the discharge of the following tasks undertaking legal analysis, preparing notes and briefs on public and international law, international civil service law, and national labor laws of Member States drafting opinions, reports and working documents on any legal problem arising in the Agencys daytoday operations and in the implementation of applicable rules and policies analysing legal documentation and carrying out studies on the relevant legal and regulatory environment in which the Agency carries out its activities monitoring the evolution of international civil service law and national labor laws relevant to the Agency and contributing to the Agencys defense before the Appeals Board and in other legal proceedings providing support in the preparation of the Agencys legal instruments providing legal advice on the formulation and interpretation of Agencys Rules and Regulations preparing draft agreements and other arrangements with public and private entities and participate in their negotiation representing the Legal Services Department and attend committees and boards relevant to the above functions. Technical competencies Stateoftheart knowledge in area of responsibility at required level Knowledge of ESAs legal environment, convention, rules, regulations and policies Knowledge understanding of the Agencys core business Behavioural competencies Continuous Learning Customer Focus Problem Solving Relationship Management Results Orientation Systems Broader Business Thinking Additional requirements Applicants should demonstrate the ability to engage with senior stakeholders the ability to work collaboratively in a team of lawyers, achieve professional goals, identify priorities and adjusts them as required a professional talent to analyze, draft and present international legal acts. Education Applicants for this post should have a Masters degree in law, including advanced studies in the law of international civil service or comparative labor law completed with professional experience of at least five years in public administrations, international organisations, private enterprises or in specialised law firms, handling legal cases and disputes based on labour law. Qualification for admission to the bar andor advanced law studies and publications in the law of international civil service on national labour laws will be a definite asset. Candidates should have a professional experience of the laws and regulations applicable to public service and private labour relations in the jurisdiction of at least one ESA Member State. Other information For behavioural competencies expected from ESA staff in general, please refer to the ESA Competency Framework The working languages of the Agency are English and French. A good knowledge of one of these is required. Knowledge of another Member State language would be an asset. The Agency may require applicants to undergo selection tests. TASKS AND RESPONSIBILITIES The LegalProcurement Officer will be in charge of Handling entire lifecycle of procurements and contract management Supporting the Agency in a broad range of legal tasks pertaining to both administrativesupport and operationaltechnical activities of the Agency The LegalProcurement Officers tasks and responsibilities will in principle include the following areas Legal advice Providing legal advice on operations and administration of the Agency Advising on the regulatory framework of the Agency Providing advice on procurement and grants Advising on staff matters, financial issues, interpretationdrafting of legal instruments Management of calls for tenders procurement Drafting, helping coordinating calls for tenders for both administrative and operational procurements in line with standard best practices Managing calls for tenders e.g. publication, organisation of and assistance to evaluation boards, selection process, contract award and signature Interfacing with relevant stakeholders, including project officers, finance department, economic operators, auditors Contract drafting and management Drafting and support negotiating contractsagreements Following up on contractagreement interpretation, implementation, performance and enforcement Assisting project officers with issues in contractagreement lifecycle Support in building and maintaining of an upto date tender, contractual and other legal commitments database Eligibility conditions The selection procedure is open to applicants who satisfy the following eligibility criteria, on the closing date for application A level of education which corresponds to completed university studies1 of at least three years attested by a diploma Be a national of a Member State of the European Union or Norway Be entitled to his or her full rights as citizen Have fulfilled any obligations imposed by the applicable laws concerning military service Meet the character requirements for the duties involved2 Have a thorough knowledge of one of the languages of the European Union3 and a satisfactory knowledge of another language of the European Union to the extent necessary for the performance of hisher duties Be physically fit to perform the duties linked to the post4 1 Only study titles that have been awarded in EU Member States or that are subject to the equivalence certificates issued by the authorities in the said Member States shall be taken into consideration. 2 Prior to the appointment, the successful candidate will be asked to provide a Police certificate confirming the absence of any criminal record. 3 The languages of the EU are Bulgarian, Croatian, Czech, Danish, Dutch, English, Estonian, Finnish, French, Irish, German, Greek, Hungarian, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Romanian, Slovak, Slovene, Spanish, Swedish. 4 Before a successful candidate can be appointed, she will be medically examined by a selected medical service so that the Agency will be satisfied that she fulfils the requirement of Article 28e of the Staff Regulation of Officials of the European Communities.
